Product replacement.

Withdrawal from the sale-purchase contract.

The company DIACONU AGRIPLANT SRL, owner of the VAGABOND STUDIO and VGB made by society stores, with its registered office in Romania, Botosani county, Răchiți locality, Industrial Area, 1st floor, office no. 1, registered at the Trade Registry Office attached to the Botosani Court under no. J7/157/2017, having CIF RO 37295920 and the correspondence address regarding the online relations between the seller and the buyer in Ilfov county,  Caldararu locality, 1D Oxigenului street, Online Department or e-mail online@vagabondstudio.com, we inform you that the purchase of products from this online store has the nature of a sale-purchase contract in simplified form and concluded remotely. Mainly, this sales report is certified in the first phase based on the confirmation and acceptance of your order, and later based on the purchase tax invoice that is delivered to you together with the purchased products. The contract takes effect from this moment until the fulfillment of 14 days from the moment when the ordered products were received by you or, as the case may be, by a third party recipient that you indicate to us, other than the carrier, insofar as no other legal provision is applicable than those provided in art. 9 para. (2) let. b) point (i) or (ii) of the G.E.O. no. 34/2014.

We want you to be up to date with all the essential information about our products and how they are purchased. The main characteristics of the products sold through the VAGABOND STUDIO online store are presented next to them together with the related sale price. In addition to this price, buyers will pay the value of transport taxes related to the ordered products, which will be delivered through the courier companies VAGABOND STUDIO, as it could be but not limited to Fan Courier Express Srl and UPS Romania Srl. Shipping fees are calculated reasonably and proportionally both with the weight of the products ordered by you and with the existing distance to the address of their delivery. The products ordered by you will be delivered within the available stock corresponding to the terms and conditions presented separately. 

  • Product replacement

Starting with the moment when you took possession of the ordered products, we come to your help, offering you the possibility to replace the products purchased on our company's website, within a period of 14 working days, by filling in appropriately the form provided as a model in Annex no. 1 of this information. The form we refer to, accompanied by the product whose replacement is intended and the photocopy of the fiscal invoice attesting its purchase, sent with declared content (product type and no./date of purchase invoice) and possibility to open the package by the recipient to verify the content, by courier services of your choice, within the above-mentioned 14 days, at the address Diaconu Agriplant Srl - Vagabond Studio, Online Department, 1D Oxigenului Street, Căldăraru village, Cernica commune, Ilfov county. For the purposes specified and within the stock available from the date of receipt of the request, the replacement of the desired products will be made provided that you bear the value of round-trip transport of the products in question and other replacement costs to the extent that they will be retained, and they meet the conditions / requirements of conformity similar to those when you or the third party recipient came into possession of the products. In the context of the cumulative fulfillment of the conditions / requirements of conformity to which we refer, we bring to your attention that they are by way of example: the product should not be in whole or in part dirty, modified, degraded, damaged or destroyed, no traces of wear or washing of the product and no unpleasant odors, the labels or inscriptions of the product are intact, the fulfillment of any other conditions / requirements of conformity existing at the date of taking possession of the product in question.

In the context of fulfilling the requirements and conditions provided in the previous paragraph, within 14 working days from the date of receipt of the product whose replacement is intended, accompanied by a photocopy of the tax invoice certifying its purchase and the replacement form, within the available stock, will we replace the product, depending on your request, with another type, model, similar or different size, having a price at least equal to the previously purchased product and subject to the replacement procedure. Any positive price difference between the product being replaced and the replacement will be borne by you.

  • Withdrawal from the sale-purchase contract

Starting with the moment when you took possession of the ordered products, you have the possibility that within a period of 14 working days, to manifest your right to withdraw in whole or in part from the contract according to the provisions of G.E.O. no. 34/2014 in force, by the appropriate completion of the form provided as a model in Annex no. 1 of this information. The form we refer to, accompanied by the product whose return is intended and the photocopy of the tax invoice attesting its purchase, must be sent with declared content (product type and no. / date of purchase invoice) and the possibility of opening the package by the recipient to verify the content, by courier of your choice, above-mentioned 14 days, at the address Diaconu Agriplant Srl - Vagabond Studio, Online Department, 1D Oxigenului Street, Căldăraru village, Cernica commune, Ilfov county. For the purposes specified, the return of the desired products will be made provided that you bear the value of round-trip transport of the products in question and the other costs related to reimbursement insofar as they will be retained, and they meet the conditions / compliance requirements similar to those from the moment you or the third party recipient came into possession of the products. In the context of the cumulative fulfillment of the conditions / requirements of conformity to which we refer, we bring to your attention that they are by way of example: the product should not be in whole or in part dirty, modified, degraded, damaged or destroyed, no traces of wear or washing of the product and no unpleasant odors, the labels or inscriptions of the product are intact, the fulfillment of any other conditions / requirements of conformity existing at the date of taking possession of the product in question.

In the context of fulfilling the requirements and conditions provided in the previous paragraph, within 14 working days from the date of receipt of the product whose return is intended, accompanied by a photocopy of the tax invoice attesting its purchase and the withdrawal form, we will refund the value of the product according to the afferent fiscal invoice or, as the case may be, of the current value in case in the meantime the product registered a value depreciation in the online store. To the extent possible, we will refund the amount thus due using the same payment methods as those used by you in making the initial transaction. To the extent that this is not possible on our part, by reading this information note and ordering the desired products, you will express your consent to the refund of the amount due in the bank account indicated by you in the withdrawal form.

The terms we refer to in this Consumer Information Note are expressed in calendar days. The term of withdrawal from the contract or replacement of a product runs from the next day you received the ordered products. If the last day of the period is a non-working day, the period shall be extended until the following first working day.

This information note is valid exclusively for the purchase of products from the VAGABOND STUDIO online platform and may differ from other procedures applicable to our physical stores.
