Withdrawal from the sale-purchase contract

 

The company Diaconu Agriplant SRL, owner of VAGABOND STUDIO stores, as it will be called further on, with its registered office in Romania, Botosani county, Botosani municipality, Calea Nationala no. 28A, floor 1, room 9, registered at the Trade Register Office attached to Botosani Court under no. J7/157/2017, having sole registration code RO 372 959 20 and the correspondence address regarding the online relations between the seller and the buyer in Romania, Wilhelm Filderman St. no. 18, floor 6, room 15-16 Sector 3, Bucharest and e-mail: online@vagabondstudio.com, operating in accordance with the laws of Romania, we inform you that the purchase of the products on this website has the nature of a sale-purchase contract in simplified form and concluded at distance. Mainly, this sales report is certified initially based on the confirmation and acceptance of your order, and later based on the purchase tax invoice that is delivered to you together with the purchased products. The contract commences from this moment until the fulfillment of 14 working days from the moment when the ordered products were received by you or, as the case may be, by a third party recipient that you indicate to us, other than the carrier, as long as no other legal provision is applicable than those provided in art. 9 para. (2) lit. b) point (i) or (ii) of the O.U.G. no. 34/2014 issued by the Government of Romania. The sale-purchase contract is governed by the legal provisions of Romania, the country in which our company has its registered office.

We would like you to be updated with all the essential information about our products and the purchasing procedure. The main features of the products sold through Vagabond Studio online store are presented together with the related sales price.

 

Product replacement

Starting with the moment when you took possession of the ordered products (delivery date of the order to the receiver), we support you by offering the option to replace the products purchased from our website with other products, within a period of 14 calendar days from receiving them, by filling the form provided as a model in Annex no. 1 hereto. The form we refer to, together with the product whose replacement is requested, and the copy of the fiscal invoice attesting its purchase, must be handed over personally or shipped with the declared content (product type and no. / Date of purchase invoice) and with possibility to open the package by the receiver for checking the content. The delivery can be done by postal or courier services of your choice, within 14 working days from receiving the products, at the following address: Diaconu Agriplant SRL - Vagabond Studio, Online Department, Romania, Bucharest, Sector 3, Wilhelm Filderman St. no. 18, floor 6, room 15-16.

As specified above and in the limit of the available stock from the date of receipt and confirmation of your request, the replacement of the products will be made provided that you cover the value of round-trip transportation of the products and other replacement costs to the extent that they will be retained, and they meet the conditions / conformity requirements similar to those when you or the third party recipient came into possession of the products. In the context of the cumulative fulfillment of the conditions / conformity requirements to which we refer, we note that these are by way of example: the product should not be totally or partially dirty, modified, degraded, damaged or destroyed, no traces of wear should be retained, or washing of the product and no unpleasant odors, the labels or inscriptions of the product are intact, the fulfillment of any other condition / requirements of conformity existing at the date of delivery of the product in question.

If the requirements and conditions provided in the previous paragraph are fulfilled, within 14 working days from the date of receipt of the product whose replacement is requested, together with a copy of the tax invoice certifying its purchase and the replacement form, in limit of the available stock, we will replace the returned product with the one indicated by you. Any price difference in plus between the product being replaced and the replacement product will be covered by you. If there is a difference in minus between the price of the product to be replaced and the price of the replacement product, we will credit this amount to your bank account that you indicate in the replacement form, within a period that will not exceed 14 working days from the moment we receive the product and confirm the possibility of replacing it.

Withdrawal from the sale-purchase contract

Starting with the moment when you took possession of the ordered products, you have the possibility within 14 calendar days, to express your right to withdraw totally or partially from the contract according to the provisions of  Government Emergency Ordinance no. 34/2014, by corresponding completion of the form provided as a model in Annex no. 1 hereto. The form we refer to, accompanied by the product whose return is intended and the copy of the fiscal invoice attesting its purchase, must be delivered in person or sent with declared content (product type and no. / Date of purchase invoice) and the possibility of opening the package to the recipient for checking the content, by postal or courier services of your choice, within the above-indicated 14 working days, at the address Diaconu Agriplant Srl - Vagabond Studio, Online Department, Romania, Bucharest, Sector 3, str. Wilhelm Filderman no. 18, et. 6, cam. 15-16. For the purposes specified, the return of the desired products will be made subject to bearing by you of the value of round-trip transport of the products in question and the other costs related to reimbursement insofar as they will be retained, and they meet the conditions / compliance requirements similar to those from the moment you or the third party recipient came into possession of the products. In the context of the cumulative fulfillment of the conditions / requirements of conformity to which we refer, we note that these are by way of example: the product should not be in whole or in part dirty, modified, degraded, damaged or destroyed, no traces of wear or of washing of the product and no unpleasant odors should be retained, the labels or inscriptions of the product are intact, the fulfillment of any other condition / requirements of conformity existing at the date of delivery of the product in question.

In the context of fulfilling the requirements and conditions provided in the previous paragraph, within 14 working days from the date of receipt of the product whose return is intended, accompanied by a copy of the tax invoice attesting its purchase and the withdrawal form, we will refund the value of the product according to the afferent fiscal invoice or, as the case may be, of the current value if in the meantime the product has registered a value depreciation in the online store. To the extent possible, we will refund the amount thus due using the same payment methods as those used by you in carrying out the initial transaction. To the extent that this is not possible on our part, by reading this information note and ordering the desired products, you express your consent to the refund of the amount due in the bank account indicated by you in the withdrawal form.

By exception from the provisions of the previous paragraph, based on the agreement of the parties and when possible for the Seller, we can offer you the possibility after you return a product, instead of reimbursing their value, to benefit from a voucher-purchase code in an amount equal to the value of the products you return. Thus, you will have the possibility, during the validity period of the voucher-purchase code and in the conditions of granting it, to make future purchases from VAGABOND Studio online store.

By exception from the previously presented provisions, in accordance with art. 16 of the Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals, issued by the Government of Romania, the right of withdrawal does not apply to contracts for the supply of goods that were not prefabricated and that require individual choice or determination of the consumer or that are clearly customized, as well as for contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if they have been unsealed after delivery.

The terms we refer to in this Consumer Information Note are expressed in calendar days. The term of withdrawal from the contract or replacement of a product, runs as of the next day when you or the third party received the ordered products. If the last day of the period is an off day, the period shall be extended until the first following business day.

This information note is valid exclusively for purchasing of products from VAGABOND STUDIO online store and may differ from other procedures applicable to our stores located in the shopping centers.
